Contract

1) AGREEMENT - This agreement between the undersigned photographer (hereafter “Photographer”) and the undersigned client, (hereafter “Client”) constitutes the entire agreement between the parties.

2) SERVICES and FEES -
All services and fees will be outlined in your quote/invoice and is dependent upon your specific project.

Perfect for those looking to sell on any e-commerce platform.
Included: Images all delivered as JPEG 1500 x 1500 pixels only
Main Image on White Background (unless otherwise requested)
Infographics as needed depending on the type of product
Lifestyle/in use images or additional white background images to showcase product
Each product photography listing purchase includes researching competitors to ensure you are competitively listed.
Also included in your purchase is all of the copywriting/content writing within your images for your infographics and selling points.

3) PAYMENT TERMS - Client shall make a payment of 50% deposit/booking fee upon acceptance of Contract.  This deposit/booking fee is nonrefundable and nontransferable.  The balance of 50% shall be due upon completion. Payment may be made via PayPal, Zelle or Venmo.

4) COPYRIGHT - Grant of any reproduction rights to the Client is conditioned upon receipt of payment in full. All rights that are not expressly granted shall be reserved by the Photographer.   Photographer grants Client the right to use the images to sell their products themselves on their
website, on social media, on Amazon or any other e-commerce platform where Client directly sells its products. 
Client may not sell the images to or allow a third party to use the images to sell Client’s products without Photographer’s written consent.

5) ADDITIONAL USAGE - If Client wishes to make any additional uses of the photographs not covered in the initial agreement, Client shall obtain written permission from the Photographer and pay an additional fee to be agreed upon.

6) CANCELLATIONS OR POSTPONEMENTS - In the event of a cancellation of a shoot by the Client or photo subject, client shall forfeit to Photographer the 50% deposit/booking fee already paid and shall not be entitled to a refund of same. If the shoot is postponed at the request of the Client, Client shall be responsible for any additional expenses incurred by Photographer to include location permit fees, model
bookings, travel expenses, etc.

7) INDEMNIFICATION - Client hereby indemnifies and holds Photographer harmless against any and all liabilities, claims, and expenses, including reasonable attorney’s fees, arising from Client's use of Photographer's work.

8) AUTHORSHIP CREDIT - A credit in the name of Bonnie Sorsby shall accompany her photos whenever practical.

9) TEAR SHEETS - Client will provide Photographer with a printed copy of any publication his/her photos appear in.

10) TURN AROUND TIME – Normal schedule for web photo gallery and/or processed JPEG files is 14 days plus any retouching. There is a 50% additional charge for 24-hour service, and 100% added charge for same day service, plus retouching time.

11) REVISIONS – Post-processing of photos include two revisions (color correction, toning, design change) in the file charge.  Client shall have seven (7) days after receipt of images to request a revision.  Any additional revisions requested by the Client will be billed at an
additional fee.

12) Permits - In the event a permit is required for Client’s photoshoot, Client shall be responsible for the permitting fees required, if any.
